1. Acceptance of Terms
By accessing or using Frizzle's services, schools, administrators, and educators ("Users") agree to be bound by these Terms of Service. The Frizzle platform is intended solely for use by educators and school staff. Students are strictly prohibited from creating accounts or accessing the platform. Schools are responsible for ensuring that only authorized personnel use the platform. By using the service, you represent that you are authorized to act on behalf of your school and are of legal age to enter into a binding contract.
2. License and Access
Frizzle grants schools and their authorized staff a non-exclusive, non-transferable license to use the service solely for internal instructional and administrative purposes. Schools may not permit students, parents, or third parties to access the platform directly.
3. Student Data Use and Ownership
Student data remains the property of the school. Frizzle processes student data only on behalf of the school and strictly for educational purposes and does not claim ownership of any user-uploaded content. Students do not interact directly with the service, and all data is uploaded by teachers or school staff.
4. FERPA and COPPA Compliance
Frizzle acknowledges that Users may upload data protected by the Family Educational Rights and Privacy Act (FERPA). Frizzle agrees to act as a "School Official" with a legitimate educational interest in handling such data and processes student information only under the direction of the school. Because students cannot access the platform, Frizzle does not knowingly collect personal information directly from students. We will sign Data Privacy Agreements (DPAs) as needed and adhere to all school obligations under FERPA and COPPA. We do not market to, profile, or sell the data of any individuals referenced in the platform.
5. User Consent
Frizzle requires user consent before collecting personal information. Explicit consent is provided by educators and administrators at the time of account creation. As this platform is not intended for student use, Frizzle does not knowingly collect personal information directly from children under the age of 13. Any student information is uploaded solely by schools, which act as the consenting authority (as required by FERPA and COPPA).
6. Google Account Integration
Users may log in using Google Sign-In. By doing so, you authorize Frizzle to access basic account information such as your name, email address, and profile image. This information is used solely for account creation and login functionality and is not shared with third parties or used for advertising. Frizzle does not request or access any classroom data, Drive files, contacts, calendars, or other Google Workspace data.
7. User Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You may not share your login credentials with students or any unauthorized individuals. You agree to notify us immediately of any unauthorized use or suspected breach of security.
8. Data Security and Breach Notification
We implement strict data protection measures, including encryption of data in transit and at rest and secure storage. In the case of a data breach, we will notify affected schools within legally required timelines.
9. Privacy Reviews and Audits
Frizzle conducts routine privacy and security internal reviews to ensure compliance with applicable laws and maintain industry best practices.
10. Termination
Schools or Educators may terminate use at any time. Upon termination, data associated with the account will be deleted in accordance with the school's instruction or applicable policy.
11. Modifications
We may update these Terms periodically. Continued use of the platform after any changes constitutes acceptance of the updated Terms.
